Advocacy in Bosnia and Herzegovina is currently not established at the state level (draft Law on Advocacy of BiH). Advocacy is organized at the level of the entities. Under the Law on Advocacy of the Federation of BiH, advocacy is an independent professional activity that is organized and functions in accordance with the law. The attorney's profession is practised by attorneys as individuals; for the purpose of joint practice, attorneys may form joint law offices and law firms. Attorneys are obliged to provide legal assistance conscientiously and professionally, in accordance with the Constitution, the law and other regulations, as well as with the Statute and other general acts of the Federal Bar Chamber and the Code of Attorney Ethics of the FBiH.

An attorney is obliged to keep as an attorney-client secret everything the client has entrusted to them, unless the attorney has been released from this obligation on the basis of the client's express or tacit consent. The attorney-client secret must also be kept by other persons working in the law office, joint law office or law firm. Attorneys in the FBiH are obliged to join one of the regional bar chambers according to the seat of their law office, and these are the Regional Bar Chambers: Sarajevo, Tuzla, Mostar, Zenica and Bihać; whereby they simultaneously acquire membership in the Federal Bar Chamber. The Bar Chamber of the Federation of BiH has its seat in Sarajevo.

The single Register of Attorneys in the Federation of Bosnia and Herzegovina is kept at the FBiH Bar Chamber in Sarajevo, while the regional bar chambers keep the Registers of Attorneys for attorneys with their seat in their respective territories. The attorney is responsible for the work of their office. In joint law offices, all attorneys are responsible for the work of the law office. In law firms, the attorneys who are members of the firm are responsible for the work of the law firm. It is the duty of attorneys, when practising law, to constantly care for the advancement and affirmation of advocacy as an independent and autonomous professional activity. Every attorney is obliged to preserve their honour, the moral character of an attorney, independence, conscientiousness and expertise, so that such conduct encourages others. The attorney's relationship with the court, other state bodies and their representatives should be an expression of respect for the law, legal culture and the legal profession.

- The seat of the Bar Chamber of Republika Srpska is in Banja Luka. The Constitution of Republika Srpska states in Article 131: "Advocacy is an autonomous and independent activity and service providing legal assistance. The organization and work of advocacy shall be regulated by law", and attorneys are obliged to provide legal assistance in the protection of the human rights and freedoms of citizens guaranteed by the constitutions of Republika Srpska and Bosnia and Herzegovina, as well as of the rights and interests of natural and legal persons defined by laws and other regulations.
